By using the PhotoPrompt AI app, the user fully accepts these Terms and Conditions. If you do not accept these terms, please do not use the service.
PhotoPrompt AI is a web application that allows users to generate images using artificial intelligence from text descriptions (prompts). The service operates through a token system: each image generation consumes a number of tokens based on the resolution and options chosen.
To use the service, it is necessary to create an account via Google or email registration. The user is responsible for the security of their login credentials. Each person may register only one account. Creating multiple accounts to obtain additional tokens is prohibited and will result in the suspension of all associated accounts.
New accounts start with 0 tokens. Users can earn bonus tokens by verifying their phone number. Tokens are consumed with each image generation. The controller reserves the right to modify token costs, bonuses and promotions at any time.
The user is solely responsible for the prompts entered and the images generated. It is forbidden to use the service to generate illegal, offensive, pornographic, violent, defamatory content, content that violates third-party rights (including copyrights and trademarks), or content depicting real people without their consent. The controller reserves the right to remove content and suspend accounts that violate these rules.
The user retains rights to images generated through the service, within the limits permitted by applicable law and the terms of the AI provider used. The PhotoPrompt AI brand, logo and app design are the property of the controller.
The service is provided "as is" without warranties of any kind. The controller does not guarantee that the service will always be available, uninterrupted or error-free. Generated images are stored exclusively on the user's device; the controller does not keep copies of images on its servers and is not responsible for their loss due to device change, browser cache clearing or app reinstallation. The controller reserves the right to modify, suspend or discontinue the service at any time.
The controller is not liable for any direct, indirect, incidental or consequential damages arising from the use of the service, including but not limited to: loss of data or images, service unavailability, undesired AI generation results, misuse by third parties.
The user may request the deletion of their account at any time by contacting support at photopromptaiassistance@gmail.com. Deletion will remove all account data from the server (profile, custom agents, remaining tokens). Images saved locally on the device are not automatically removed. This action is irreversible.
The controller reserves the right to modify these Terms and Conditions at any time. Changes will be published on this page. Continued use of the service after the publication of changes constitutes acceptance of the new terms.
These terms are governed by Italian law. For any dispute, the court of the controller's place of residence shall have jurisdiction.
